Is there a minimum amount of logging income I can earn before I must pay logging tax? |
|
No. All income from logging operations is subject to logging tax. |
If I take down trees on my property and sell them or the wood from them, is that considered "logging income"? |
|
Yes. There is no minimum amount of income or number of trees for it to be considered "logging income". |
If I have a loss from logging, do I have to file a Logging Tax Return? |
|
Yes. If you have logging operations you must file a Logging Tax Return regardless of earnings or losses. |
Do I have to report my logging income on my Logging Tax Return as well as my Income Tax Return? |
|
Yes. Logging tax is separate from income tax. Logging operations must be reported on both your Logging Tax Return and your Income Tax Return. |
What happens if I forget to file a Logging Tax Return? |
|
You should make a voluntary disclosure to avoid paying penalties. A taxpayer who makes a voluntary disclosure of a tax liability for a tax year or years, or is a first-time filer, will not be subject to penalty if the taxpayer is in accordance with the conditions outlined in Bulletin LTA 003, Voluntary Disclosure: The Logging Tax Act.
We will, for the respective tax year or years, waive all penalties associated with late or deficient tax payments and non-filing of the tax return. |
Why do I have to send in my Income Tax Return and financial statement to the provincial government when I already sent it to the Canada Revenue Agency (CRA)? |

The province does not have access to the information you provide to the CRA. Therefore, we require copies of these documents with your Logging Tax Return. |
I logged only once, and the Income Taxation Branch keeps sending me Logging Tax Returns. What should I do? |
|
If you do not intend to log again, you may write to us and request that your logging tax account be deactivated.
If you resume logging operations in the future, you must file a return with us at that time. |
There were special circumstances which caused me to be late with my Logging Tax Return. What can I do to avoid paying penalties and interest? |
|
We may waive or cancel interest and penalties in whole or in part where they result from circumstances beyond a taxpayer's control. We also may cancel or waive interest or penalties if they arose primarily because of actions of the branch.

Logging tax instalment payments can also be made at Service BC - Government Agent offices. Some financial institutions also can accept instalment payments; contact your bank or credit union for more information. |
My accountant called the Logging Tax section and was unable to get any information about my account. Why? |

We cannot disclose information about your account to anyone other than yourself unless we have a signed Authorization Form from you on file. |

Can I make instalment payments? |
|
When agreed upon, short term payment arrangements are considered for a period of six months or less. For approval of payment proposals which are longer than six months, we require that you provide detailed financial information, and it will be necessary to secure the debt by registering a lien against your property. Interest continues to accrue on all unpaid balances. |

Do you accept credit card payments? |
|
No, we do not accept credit card payments. |
Are you a private collection agency? |
|
No, we are not a private collection agency. The Receivables Management Office is a branch of the Ministry of Small Business and Revenue that collects outstanding taxes owing to the province. |
What do you mean by "Legal Action"? |
|
The province has available remedies that it may use to collect overdue taxes under its various tax statutes. These remedies include:
- Demands on bank accounts
- Employers and third parties
- Liens
- Certificates of Judgement
- Federal Government refund set-offs
- Writs of Seizure and Sale

Will legal actions have an effect on my (my company) credit rating? |
|
This will depend on the collection action which has been undertaken in an attempt to collect the outstanding balance. |
Why have I received a notice from the Land Title Office telling me a Judgement is registered on my property? |
|
The Land Title Office is required to send you a notice informing you that a lien has been registered on your property. This notice gives you an opportunity to dispute the lien if you believe the lien has been filed in error. You may receive this notice after your account has been paid or reversed. |
When will the lien on my property be removed? |
|
We will remove all collection action including a property lien once you have paid the account in full or the assessment of tax has been reversed. |
